The international media has reported on the prevalence of domestic violence as a result of the call for lockdown. In Singapore, the Ministry of Social and Family Development (“MSF”) has made preparations to handle crisis response for victims of domestic violence.

 

Special measures have also been taken by the Family Justice Courts (“FJC”) in handling domestic violence during the circuit-breaker period (“period”). In light of encouraging parties to practice proper social-distancing measures, the FJC will hear matters via video conferencing.

 

An urgent application to the FJC will only hear urgent and essential matters (time-sensitive) matters involving:

  1. threat to life and liberty; and/or
  2. urgent needs of the family.

 

Family/Domestic violence is a threat to one’s life and liberty, and it is an urgent need of the family.

 

What constitutes family violence? Section 64 of the Women’s Charter sets out the following:

 

  • Willfully or knowingly placing, or attempting to place, a family member in fear of hurt;
  • Causing hurt to a family member by such act which is known or ought to have been known would result in hurt;
  • Wrongfully confining or restraining a family member against his will; or
  • Causing continual harassment with intent to cause or knowing that it is likely to cause anguish to a family member.

 

If you have been a subject of an existing abuse / violent treatment, the circuit-breaker period does not prevent you from commencing action to protect yourself. Our lawyers are available to assist you with making the necessary application to protect your safety and your loved ones.

 

Should physical harm be caused onto you, do ensure that you have photographs of your injury/injuries as documentary evidence, and seek immediate medical attention for an assessment by a medical professional.
